<description>&#60;p&#62;I am not sure I understand the proper licence I need (nc or not).&#60;br /&#62;
My aim (in the context of acquiring a piece of graphical software) is to be able to use a piece of software, namely internet templates, in a commercial context but without selling this piece of software (inculding it in a more general work, but not charging for this part, of course).&#60;br /&#62;
I am not sure : sould I use a by-nc-sa licence or a by-sa licence ?&#60;br /&#62;
In other words, is the kind of usage I am looking forward to make consistent with the nc clause ?&#60;br /&#62;
The local context is France.&#60;br /&#62;

<description>&#60;p&#62;I would like to see the answer to this question as well. Many people interpret non-commercial reuse in different ways. I would like to see what this term specifically means under a Creative Commons license.&#60;/p&#62;
&#60;p&#62;For example, (while taking this situation into consideration) some people believe that it follows under the terms of non-commercial reuse if one duplicates and redistributes a copy of another author's material without charging for its view in any way to his or her own respective viewers, even if this site is profiting from the viewing material in some way, shape, or form. (Ex. Putting an ad of the site's e-commerce store next to the duplicated material that sells items related to the licensed material. In this case the copy and pasted material would attract viewers and then direct some of these viewers to buy the duplicator's products.) Other people may believe that non-commercial reuse means that any duplicated material cannot be established on any site that profits from it in any way, shape, or form. (This would even include the situation stated above.)&#60;/p&#62;
&#60;p&#62;Which one situation is correct according to the license? Or perhaps is it under the authority of the licensee to choose which specific situation is acceptable or not? Any response would be appreciated!

<description>&#60;p&#62;As a professional writer, I naturally expect to get paid something for my work.  For my own website, The Mex Files (&#60;a href=&#34;http://mexfiles.net)&#34; rel=&#34;nofollow&#34;&#62;http://mexfiles.net)&#60;/a&#62;, I added a CC License to allow educational and non-profit groups access to my material (and, I hope, sell some of my books, or get me a paying gig).  My feeling is that a group that is using written material for their own profit should pay their workers -- the writers.  &#60;/p&#62;
&#60;p&#62;I've run into a situation lately where another user here in Mexico is reposting my material (at least credited to me) on a site designed to drum up business for his real estate company.  I have requested he not do that.  He said he wasn't, but then again today (the day after telling me he had taken down my material) he again did the same thing.  &#60;/p&#62;
&#60;p&#62;Short of getting an &#34;amparo&#34; (our version of a court order) against him, any steps I can take to stop this kind of thing.  &#60;/p&#62;
&#60;p&#62;AND... what do others consider &#34;non-commerical reuse&#34; anyway?

&#60;p&#62;I have a two part question with different conditions.&#60;/p&#62;
&#60;p&#62;To put it simply, we will allow users create and upload unique content - something like YouTube or Squidoo&#60;br /&#62;
(by this point we will be owners of the content according to our TOS)&#60;/p&#62;
&#60;p&#62;We will then have a widget that will allow anybody to take this content and embed it in their site.  &#60;/p&#62;
&#60;p&#62;QUESTION 1 &#60;/p&#62;
&#60;p&#62; Just based on this above - I would think that we would use a Attribution, Non-commercial,  No derivatives license?     However I am completely confused exactly what it means by Non-Commercial.   &#60;/p&#62;
&#60;p&#62;Meaning that I DO NOT want people to sell or directly profit from the content or widget provided - however like YouTube widget, it will be used extensively by bloggers  or sites some of who have a 'Commercial operation' meaning they are registered as a business and make their living from the website.   In this regards it is fine to use.   &#60;/p&#62;
&#60;p&#62;QUESTION 2&#60;/p&#62;
&#60;p&#62;There may also be an XML feed of the content Data for other users to use and format as they like.  Something to be able to create Mashups of data - like flickr or Google Maps provides.&#60;/p&#62;
&#60;p&#62;My question is what license do we use in this case - is it still the non-commercial no-derivatives license.    does a MASHUP constitute a derivative?&#60;/p&#62;

<description>&#60;p&#62;I am not a lawyer, but I'm not sure merely posting on myspace is a commercial use -- myspace may be like an ISP or copy shop in this case -- so whether it is a commercial use or not depends on whether you (the person posting someone else's noncommercial content) are making commercial use of your myspace page. But again, I am not a lawyer and this is not a place to get legal advice.&#60;/p&#62;
&#60;p&#62;How would you best make an agreement?  Start by emailing the relevant artist.&#60;/p&#62;
