Take a careful look of its provisions, from there you can continue your claim, you can either do a compromise or submit to the terms of the license. If it is Non-Commercial, you might have a case, if not, then there is nothing you can do. A commons misconception of Creative Commons is that it replaces copyright, it doesn't. CC is in addition to copyright, if someone infringes the CC license (say makes a derivative of a 'no derivatives' licence), they are infringing traditional copyright and can be treated as such. You cannot retrospectively remove a Creative Commons license you voluntarily places on your work, you can release subsequent editions/publications with a different or no license, but any versions the originate from the original CC license will continue to remain with that license. What type of income, is it actually a profit? The administration of Wikipedia still gets paid even though it's a non-profit, and thus non-commercial entity. petruccimusiclibrary.org has adverts that (help) pay for hosting of the site, but they are still non-commercial and a not-for-profit entity. If they make money but not profit, even a non-commercial CC license might not help you. Regards, Yagan P.S. see if you can work out some sort of middle ground. May I ask what the need of removing it is? mojo on "where do i stand" http://forum.creativecommons.org/topic/168#post-329 Mon, 18 May 2009 05:21:01 +0000 mojo 329@http://forum.creativecommons.org/ hi, i joined a discussion forum and during my membership there i created a number of original stories and poetry and also some originally researched discussion pieces. the forum in question is based in the US and is covered by creative commons, i'm based in australia. ive since left the forum and wish to re-use my material and also license it myself. ive asked the forum to remove my material previously and they refused. the forum in question receives income from the use of "user" content. my questions, if i copyright my material am i able to ask for it to be removed from their site? if not, am i able to receive remuneration from them due to them making income from my content? thanks for any help you may have.
