Let's say an artist decides to upload his song onto a music website to allow users to stream and listen to his/her music. Under the Creative Commons license options, he doesn't allow the website to use it for commercial purposes. Does this mean that the website is not allowed to place banner ads on the web page that is streaming the song? Secondly, who decides what is defined as commercial use?

Usually when an artist uploads a track to a website, especially mp3 upload sites and social networks, there is usually a terms of service thing that the uploader agrees to and gives the site the right to display, distribute, perform etc the track.
You are in effect giving the website permission to use your works and for them to put banners on the page that your music is on.
as the Creative Commons license says "Any of these conditions can be waived if you get permission from the copyright holder."
By uploading to these sites and agreeing to their terms, you are waiving those conditions
Bdwerk is right usually those social sites has terms .before you upload your song you have to agree on there terms before you could upload.

Its a shame a lot of these people don't read the terms before uploading their songs. Once you upload it to certain sites, the site owners can use your songs for their own purpose.
cliffordribee, this doesnt bother me at all. They are giving me free server space and free promotion. Im not paying a thing for using their bandwidth (which costs money) so why bother when they can use your music for whatever. Doesnt bother me one bit.

I agree with bdwrek, usually when you have uploaded the music you just hope that someone will appreciate the song. And most artist do that, right?
